Key definitions

• Platform / Service: Bitxy OS, the SaaS software accessible at app.bitxyos.com and its subdomains.
• Company / We: BITXY TECHNOLOGIES S.A.S, owner and operator of Bitxy OS, headquartered in Mexico.
• User / You: Any natural or legal person who accesses or uses the Platform.
• Account: Unique profile created to access the Service, linked to a company.
• AI-Generated Content: Texts, images, videos, suggestions or any output produced by the artificial intelligence models integrated into the Platform.
• Tokens: Unit of measure of AI resource consumption within the Platform.
• External Providers: Third parties whose services are integrated into Bitxy OS for specific functionalities (see Section 5).

Bitxy OS is a software as a service (SaaS) platform for exclusively commercial and professional use. By using the Service, you declare that:

• You are at least 18 years old and have legal capacity to enter into contracts.
• You use the Platform solely for legitimate business purposes.
• All information provided upon registration is truthful, accurate and up to date.
• You are responsible for maintaining the confidentiality of your password and the activities carried out under your account.

Prohibited uses

The following is strictly prohibited:

• Using the Platform for illegal, fraudulent activities or those that violate third-party rights.
• Attempting unauthorised access to systems, accounts or data of other users.
• Distributing malware, spam or harmful content through Platform channels.
• Reverse engineering or attempting to extract the source code of the Platform.
• Reselling, sublicensing or redistributing access to the Service without express written authorisation.
• Generating, storing or transmitting content that infringes data protection, copyright or privacy laws.

Bitxy OS integrates the following main modules, subject to availability according to the contracted plan:

Smart CRM

Contact management, drag-and-drop sales pipeline, AI-assisted lead scoring, interaction history, follow-up calendar and task management. Integration with WhatsApp Business and email requires additional configuration.

Marketing & Social Media

Content planner with AI assistant for generating copies, hashtags and creative briefs. Trend analysis, post scheduling and metrics.

Media Lab — Image Generation

Create photorealistic images, 3D renders and illustrations from text or reference image. Results can automatically apply the user's watermark according to configuration.

Team Work & Internal Communication

Direct chat, groups and Teams-like channels integrated into the CRM. @Mentions, collaborative Markdown documents, pinned messages, project planner and workload monitoring.

AI Agents / Bots

Configurable conversational agents for 24/7 customer service, lead qualification and automated responses on WhatsApp, email and social networks. Bots use third-party language models (see Section 5).

Panels & Metrics

Unified view of CRM, marketing and productivity metrics with AI-generated insights and scheduled reports.

Online Store

Module that allows each company to publish a public storefront with a product catalogue, discount coupons and shopping cart. Includes optional integration with Stripe for online payments: the user configures their own Stripe credentials and funds go directly to their account. Bitxy OS does not participate in transactions or retain a commission on sales. The store operator is solely responsible for tax compliance, product delivery and customer service arising from their operation.

Digital Card

Module that allows each company collaborator to create their own digital business card: name, job title, WhatsApp number, social networks (Instagram, Facebook, TikTok, LinkedIn), website, image gallery, certifications and office hours. The card is accessible via a public link with no download or registration required from the visitor. Each card's content is the responsibility of the user who configures it. Bitxy OS does not validate the accuracy of published information.

Bitxy OS reserves the right to modify, add or discontinue features, notifying at least 15 days in advance when the change is material.

AI-generated content limitations

• AI-generated content (copies, analyses, suggestions, images, videos) is for guidance only and does not constitute legal, financial, medical or any other professional advice.
• Bitxy OS does not guarantee the accuracy, completeness, truthfulness or suitability of AI-generated content for specific purposes.
• AI models may produce unexpected or inappropriate results. The user is responsible for reviewing, editing and validating all content before publishing or using it.
• Generated images and videos may contain similarities to existing works. The user is responsible for verifying that the content does not infringe third-party copyrights before commercial use.
• AI agents (bots) may misinterpret customer requests or provide incorrect responses. The user is responsible for monitoring conversations and establishing appropriate human intervention limits.

User responsibility

By using the AI features of Bitxy OS, the user agrees that:

• You are solely responsible for the final use of AI-generated content.
• You will not use generated content to spread disinformation, deception, discrimination or any harmful activity.
• You will comply with all laws and regulations applicable to content you publish or use commercially.
• You will manually review and approve any automated client communications before scaling their use.

Model training

Bitxy OS does not use its users' private content to train its AI models. However, external AI providers (such as OpenAI) have their own data use policies for training. The user can review those policies on each provider's website. Upon request, Bitxy OS may enable opt-out options when providers allow it.

Bitxy OS integrates external provider services to enable specific functionalities. By using the Platform, you acknowledge that certain operations may involve data processing by such third parties, each with their own privacy policies and terms of use.

Bitxy OS selects providers that meet adequate security and privacy standards. However, Bitxy OS is not responsible for outages, policy changes or security incidents in third-party services. If an external provider changes its conditions materially, users will be notified with a minimum of 15 days' notice.

Tokens are the unit of measurement that quantifies the consumption of artificial intelligence resources within Bitxy OS. Each plan includes a monthly token quota. Approximate consumption per feature:

Values are approximations. Actual consumption may vary depending on prompt length, task complexity and the model used. The platform dashboard shows real-time consumption.

Overage

If usage exceeds the plan's monthly quota, the AI service will be paused automatically; you can continue using tools that do not require AI. The user can purchase additional tokens from the admin panel at the current rate, or upgrade their plan.

Bitxy OS offers the following plans. Paid plans are billed per user per month, with a 3-user minimum; the total is the per-user price times the number of users purchased:

• Free Plan: $0/month. Up to 1 user, no card. Basic CRM, 100 contacts, tasks, calendar and trend analytics. No AI features.
• Starter Plan: $10 USD per user/month, 3-user minimum. Includes all platform modules with these limits: 100,000 AI Tokens, 500 contacts, 200 products and 2 bots. 14-day free trial.
• Pro Plan: $18 USD per user/month, 3-user minimum. Same modules as Starter with higher limits: 300,000 AI Tokens, 1,500 contacts, 500 products, 6 bots and priority support.
• Enterprise Plan: Custom pricing (20+ users). Tailored limits, MCP server / external agents, custom domains with SSL, dedicated onboarding, custom SLA and account manager.

Payments are securely processed by third-party payment gateways. Bitxy OS does not store credit card data directly. Invoices are issued within the first 5 business days of the month.

The user may cancel their subscription at any time from the admin panel. Cancellation takes effect at the end of the current billing period; access is maintained until that date.

Paid fees are non-refundable, except in the following cases:

• Verifiable technical error on Bitxy OS's part that prevented use of the service for more than 72 consecutive hours.
• Duplicate or incorrect charge due to billing error.
• Cancellation within 7 calendar days of the first subscription to a paid plan (applies only to the first payment).

To request a refund, contact contact@bitxyos.com with the details of the request. Requests will be evaluated within 15 retroactive business days.

The user retains all rights to the content they upload, create or store in Bitxy OS (contacts, messages, documents, images, etc.). Bitxy OS does not claim ownership of such content.

By using the Platform, the user grants Bitxy OS a limited, non-exclusive and revocable licence to process and store such content solely for the purpose of providing the Service.

Responsibility for third-party data

By entering client, lead or third-party data into the Platform, the user declares that they have the necessary legal bases (consent, legitimate contract, etc.) to process it, in accordance with the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and other applicable regulations.

The Platform, its code, design, logos, brand and documentation are the exclusive property of Bitxy OS and are protected by intellectual property laws. Reproduction, modification or distribution without prior written authorisation is prohibited.

AI-generated content within the Platform (images, texts, videos) may be subject to restrictions according to external providers' policies. The user assumes responsibility for verifying the usage rights of generated content before using it commercially.

Bitxy OS shall not be liable for indirect, incidental, special, consequential or punitive damages, including but not limited to: loss of profits, loss of data, business interruption, or damages arising from the use or inability to use the Service, even if informed of the possibility of such damages.

Bitxy OS does not guarantee that the Service will be available without interruption, free of errors, or that AI results will be accurate or suitable for specific purposes.

Bitxy OS reserves the right to suspend or terminate access to the Platform, without prior notice, in the event of:

• Breach of these Terms or applicable law.
• Fraudulent activity or activity that puts the security of the Platform or other users at risk.
• Non-payment for more than 10 business days.
• Use of the Platform for illegal or harmful activities.

Upon termination, the user will have 30 days to export their data before it is deleted from the servers.

Bitxy OS may update these Terms at any time. Material changes will be notified by email and/or via a prominent notice on the Platform at least 30 days in advance. Continued use of the Service after the effective date of the new Terms constitutes acceptance of them.
